I. Personal data

The pansatori GmbH, FN 518780, Laabstrasse 96, 5280 Braunau am Inn, Austria, collects, processes and uses personal data of its customers for the purpose of providing our services. The collection and use of personal data of our customers takes places regularly and only after consent of the customer. An exception applies in those cases where a prior consent is not possible because of practical reasons and the processing of data is permitted by legal provisions.

Only personal data that is necessary for the accomplishment and execution of the agreed services is collected or data that you have provided voluntarily.

Personal data includes all data containing individual indications about personal or factual circumstances such as name, address, e-mail address, telephone number, date of birth, age and sex.

II. Legal basis for processing personal data

As far as we get the permission for processing personal data from the person affected, Art. 6 Par. 1 lit. a General Data Protection Regulation of the EU (GDPR, in German: Datenschutzgrundverordnung = DSGVO) serves as legal basis for processing personal data.

For processing personal data that is necessary to execute a contract whose contracting party is the person affected, Art. 6 Par. 1 lit. b GDPR serves as a legal basis. This also applies to processing required for the accomplishment of pre-contractual measures.

As far as processing of personal data is necessary for compliance with a legal obligation, to which our company is subject, Art. 6 Par. 1 lit. c GDPR serves as a legal basis. In case vital interests of the person affected or another natural person make it necessary to process personal data, Art. 6 Par. 1 lit. d GDPR serves as a legal basis.

III. Disclosure and deletion

Personal data of the person affected is deleted or blocked as soon as the reason for storage ceases to be relevant. A storage can take place when this was intended by the European or national legislator in regulations, laws or other provisions of the European Union, to which the person responsible is subject. Blocking or deletion of data takes place as soon as a data retention period prescribed by the mentioned norms expires, unless there is a necessity to further store the data for a conclusion of contract or performance of a contract.

Please report any changes to your personal data to us.

You have the right to withdraw your consent to use your personal data at any time. Your request to inform, delete, correct, withdraw and/or for the last-mentioned data transfer can be directed to the address mentioned below in Point XI of this declaration, as long as this is not connected with a disproportionate effort.

If you consider the processing of your personal data on our part as a violation of the current data protection law or data protection needs have been violated in another way, there is the possibility to complain to the competent supervisory authority. In Austria, the data protection authority is responsible.

IV. Data security

The protection of your personal data is ensured by appropriate organisational and technical measures. These measures concern the protection against unauthorised, unlawful or random access, processing, loss, use and manipulation. Regardless of the efforts to always comply with a consistently high degree of diligence, it cannot be excluded that information provided via the internet can be seen or used by other people.

Please note that we cannot be made liable for the disclosure of information due to mistakes not caused by us during data transfer and/or unauthorised access by third parties (e.g. hacker attack on e-mail account or telephone, interception of faxes).

V. Use of data

We will not process data provided by you for any other purpose than for order execution. The use for statistical reasons is excluded from this, as long as the provided data was anonymised.

Also data that is transferred in connection with our app ForgTin is excluded from this. Both online questionnaires TSCHQ (Tinnitus Sample Case History Questionnaire) and somatic tinnitus, which are automatically mailed to you after purchasing your ForgTin, are excluded from this. The transferred user and history data is saved in anonymised form and used for reasons of research and development (e.g. medical studies and evaluations). We are not authorised to use the data for other reasons. The customer is entitled to withdraw his consent at any time.

VI. Reporting on data leaks

We are eager to ensure that data leaks are discovered early or reported immediately to you or the competent supervisory authority taking into consideration the respective data categories affected.

VII. Storage

We will not store data longer than necessary to accomplish our contractual or legal obligations and reject any liability claims.

VIII. Cookies

This webseite uses „cookies“ to make our offer more user-friendly, more effective and more secure.

A „cookie“ is a small text file that we transfer via our web server to the cookie file of the browser to the hard disk of your computer. This allows our website to recognise you as a user when a connection between our web server and your browser is established. Cookies help us to determine the user frequency and the number of users of our website. The content of the cookies used by us is limited to the identification number allowing no direct reference to individuals. The main purpose is the recognition of the visitors of the website.

In this website we use the Facebook Pixel of Facebook, a Social Media Network of the company Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland. This can be used for the improvement of Facebook advertisements. The collected data cannot be seen by us and is only usable within the framework of ad placements. By using the Facebook-Pixel-Codes cookies are set.

IX. Server log files

To optimise this website with regard to system performance, user-friendliness and provision of useful information about our services, the provider of the website collects and saves information automatically in so-called server look files that your browser transfers automatically to us. This includes your Internet protocol address (VIP address), browser und language setting, operating system, referrer URL, your internet service provider and date/time. Connecting data with personal data sources does not take place. We reserve the right to examine these data retrospectively, if we have solid evidence for an unlawful use.

X. Google Analytics

This website uses Google Analytics, an advertising analysis service of the Google-Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA, on the legal basis of the predominant legitimate interest (analysis of the website use). For this reason, we have made a contract with Google on order processing.

Upon visiting our website a connection is established via a software with servers of Google and data is partly transferred to servers in the USA by Google. Google Analytics also uses cookies to save information about the website user and for the analysis of the use of the website.

This website uses the function „IP anonymisation“. Thus your IP address is reduced and anonymised by Google within the member states of the European Union or other contracting states of the agreement on the European Economic Area. In rare cases the full IP address is transferred to a server of Google in the USA and reduced there.

According to Google, Google uses the collected data to evaluate the use of the website, to compile reports about advertising activities and to render further services connected with website use and internet use.

Google will also transfer this information to third parties, as long as this is prescribed legally or third parties process this data on behalf of Google.

You can generally prevent collection of your user data on our website by setting „Do Not Track“ in your web browser. Our website takes into consideration the „Do Not Track“ signal that is sent to all websites via the browser.
